CONDITIONS OF PARTICIPATION AND INFORMATION ON DATA PROTECTION
Flughafen München GmbH, Nordallee 25, 85356 Munich Airport (hereinafter “organizer” or “we”/”us”) is conducting the survey on smart baggage trolleys at Munich Airport and the associated prize draw (hereinafter “campaign”). The following conditions of participation shall apply here.
To secure your chance to win an iPad mini (2022) (64 GB), you simply have to answer a few question about your experiences with our smart baggage trolley. You can do this directly using the form from which you accessed these conditions of participation.
So that we can let you know if you have won, please provide us with your e-mail address (this e-mail address will be used solely for the purposes of informing you that you have won and not for other purposes). You can also take part in the survey without giving your e-mail address, although this means that you will not be entered in the prize draw.
From all the participants, the winner will be chosen at random. Participation is free of charge and not dependent on the purchase of any goods or services.
Only natural persons with full legal capacity and who have reached the age of 18 are eligible to participate. Multiple entries are excluded from participation. Employees of the agency commissioned with the design, of the organizer and/or affiliated companies as well as their respective relatives and life partners are excluded from participation.
The winner will be informed by e-mail. The winner will not be announced publicly. The other participants will not be informed.
In the e-mail sent to the winner, the winner is asked to contact us and tell us their postal address so that we can dispatch the prize. If the winner cannot be reached via the e-mail specified or does not respond within two days to tell us the details we need so that can dispatch the prize, they will be excluded from the prize draw and the prize will be forfeited. In this case, it is at our reasonable discretion whether we select another winner as a substitute – the above provisions shall apply accordingly to this person.
The organizer furthermore reserves the right, at its own discretion, to exclude persons from participation if there is an important reason for doing so, for example:
a) in case of manipulation related to access to the campaign or the execution of the campaign;
b) in case of breaches of these conditions of participation;
c) in case of unfair conduct;
d) in case of false or misleading information in relation to the campaign.
2) Period of participation
Participation is possible in the period from 09/18, 2023, through 12/31, 2023, within the security area of Munich Airport and, within this period, daily from 06:00 a.m. through 10:00 p.m. The winner will be informed at the latest by 01/31, 2024.
3) Cancellation and termination of the campaign
The organizer is entitled to terminate the campaign prematurely for good cause without notice and without giving reasons. This applies in particular in the event of disruptions for technical, organizational or legal reasons that prevent the proper execution of the campaign.
The organizer shall be liable only for damages incurred by the participant due to grossly negligent or intentional conduct on the part of the organizer or one of its vicarious agents or due to the violation of essential contractual obligations (i.e. such obligations whose fulfillment makes the proper execution of the prize draw possible in the first place and on whose compliance the participant may regularly rely). The aforementioned limitation of liability does not apply to damages caused by the loss of life, physical injury or damage to health of the participant.
The right of appeal is excluded. No actionable claim exists with regard to the prize or payment of the cash value. The prize cannot be exchanged, nor can it be transferred to other persons. The law of the Federal Republic of Germany shall apply. In relation to a consumer, this choice of law shall apply only to the extent that it does not restrict any mandatory statutory provisions of the state in which the consumer is domiciled or habitually resident.
6) Data protection information
